
Robert Neinast had appealed last year’s district court decision, arguing that the library’s policy against bare feet infringed his constitutional right to receive information. Neinast had been evicted from the library for not wearing shoes on several occasions between 1997 and 2001.
“In this case, as long as Neinast wears shoes, he may receive information in the library,” Judge Julia S. Gibbons wrote for the unanimous three-judge panel.
