ABA to Evaluate UCITA

The American Bar Association has postponed a vote to oppose the Uniform Computer Information Transactions Act and instead established a task force to examine the strengths and weaknesses of the legislation. The task force, formed August 2 at the ABA annual meeting in Chicago, is charged with finding out if there is a way to work out differences of interpretation in the proposed law, according to ABA Torts and Insurance Practice Section Staff Director Susan Lynch.

Carol Ashworth, UCITA grassroots coordinator for the American Library Association’s Washington Office, told American Libraries that members of the ABA House of Delegates had received letters from both proponents and opponents of the law, including many librarians nationwide. “They were feeling an unusual amount of pressure from outside their organization,” she said.

Members of the new task force will meet with the National Conference of Commissioners of Uniform State Laws in Washington, D.C., November 16–17 to consider modifications, NCCUSL spokesperson Katie Robinson told AL. Meanwhile, the commissioners have agreed to postpone their push for the states to adopt UCITA, although proponents such as Microsoft or AOL are under no obligation to stop lobbying.

Ashworth said that librarians wishing to voice their opinion on UCITA could contact the ALA Office for Information Technology Policy.
