
A homeless man with six prior criminal convictions will be serving 8–15 years in prison for sexually assaulting an employee of the Hackley Public Library in Muskegon, Michigan, last spring. The sentence, which was handed down August 28 by Muskegon 14th Circuit Chief Judge Timothy Hicks, exceeds the minimum guidelines of 22 months established by state law for fourth-degree criminal sexual conduct.
After a bench trial, Donald W. DuBoise, 43, was convicted of sexually touching a Hackley library staffer while she was shelving books on the morning of April 7. Prosecutors were unable to bring felony charges against DuBoise because the library failed to report the crime immediately, according to the August 29 Muskegon Chronicle.
The sexual attack was the second incident in six months at the Hackley Library. Elvis Tarrease Day Jr., 18, has been held on charges of first-degree criminal sexual conduct since late last year in the November 2 rape of a 10-year-old girl in the library’s basement restroom. Officials are determining whether Day is competent to stand trial.
