Child Online Protection Act Hearing Begins

A hearing began January 20 on the American Civil Liberties Union's effort to block enforcement of the Child Online Protection Act, which requires Web sites to obtain proof of age before allowing viewing of material considered “harmful to minors.”

Witnesses for the ACLU included Donna Hoffman, a professor of management at Vanderbilt University who is an authority on electronic commerce; Chris Barr, president of the CNet online news service; Michael Tepper, who runs an Internet site that helps disabled people who experience sexual dysfunction; and Thomas Reilly, founder of the PlanetOut gay and lesbian Web site.

Several of the plaintiffs have asked that part of their testimony be closed, since it involved trade secrets. News organizations covering the case are fighting the request.

Witnesses for the Justice Department were scheduled to testify in the second phase of the hearing. U.S. District Judge Lowell A. Reed, who delayed enforcement of the law in November, is expected to rule on the case by February 1.
