New Mexico Criminalizes Cybersmut

On March 9 New Mexico Gov. Gary Johnson signed into law a bill that makes it a misdemeanor to "intentionally use a computer communication system" to disseminate material that "in whole or in part depicts actual or simulated nudity, sexual conduct, or sadomasochistic abuse, and that is harmful to minors." The law goes into effect July 1.

"The ACLU will challenge this law. They set 'em up. We knock 'em down," spokesperson Emily Whitfield remarked to the CNET Internet news service later that same day, referring to the February 26 overturning of a similar Virginia statute and the June 20, 1997, reversal of a New York law, the latter a case in which ALA and the Westchester Library System were among the plaintiffs (see American Libraries, Aug. 1997, p. 12).
